Protection from Harassment Act 1997

The court heard in Maughan v Wilmot [2019] EWHC 2765 (Fam) that divorce proceedings between Captain Wilmot and his former wife began in 1999.

Mostyn J said in the case: “I turn to the application for an order under the Protection from Harassment Act 1997. There can be no doubt that the respondent has grossly harassed the applicant, their children, and her legal representatives. Section 3(1) and (3) of the Act allows the High Court to grant an injunction for the purpose of restraining the respondent from pursuing any conduct which amounts to harassment. Under section 3(6) breach of such an injunction would amount to a criminal offence.”

The judge said: "I therefore grant the application in the terms sought".
